SMS Text Messaging Terms and Conditions

Graco Inc. (“Graco”) provides this policy to explain how we use SMS text messaging where supported by your wireless carrier. This policy is subject to applicable laws in the jurisdictions where Graco offers SMS Text Messaging services. Please read these SMS Text Messaging Terms and Conditions carefully. By agreeing to receive text messages from or on behalf of Graco, or by otherwise providing your phone number to Graco, you agree to these SMS Text Messaging Terms and Conditions, as well as Graco’s Terms of Service and Privacy Notice.

1.  Opting-In

To receive text messages from Graco, follow the instructions provided by Graco, which may include texting a message to a short code, providing us with your phone number online through our website, or otherwise providing your oral, written, or electronic consent.

Opting-in to receive messages is not required to purchase any products or services from Graco. By providing your mobile number and opting-in, you agree you have ownership rights or permission to use the number given to Graco. When interacting with Graco, you agree not to use or provide any phone number that does not belong to you or that you are not authorized to use.

2.  Frequency of Text Messages

This text messaging service is for direct communication between you and Graco representatives. We may send you an initial message providing details about the service. The frequency of messages depends on your interactions with our service; for example, if you request assistance by texting HELP, you may receive additional messages in response.  

3.  Cancellation

To stop receiving text messages from Graco, you can reply STOP to the number sending the message. After replying STOP, you may receive one final text message confirming you have opted out.

4.  Use of Data

Data obtained from you in connection with this text messaging service may include your mobile phone number, your wireless provider’s name, the date, time and content of your messages, and other information you provide to Graco as part of this service. Graco may use this information to contact you and provide services you request from Graco, such as customer support. Graco will not share your personal data with any third parties or affiliates for marketing purposes.

5.  Fees and Charges

Message and data rates may apply for any messages sent to you from or on behalf of Graco, or that you send to Graco. Graco does not charge additional fees for sending SMS messages, but you are responsible for any charges imposed by your wireless provider. If you have any questions about your text plan or data plan, please contact your wireless provider.

6.  Disclaimers; Limitations on Liability

Graco does not promise that SMS Text Messaging will be uninterrupted or error-free. Messaging may not be available in all areas, at all times, or on all mobile providers. Graco is not liable for any delays, message failures, or other technical issues. To the maximum extent permitted by law, you agree to indemnify and hold harmless Graco and its affiliates, officers, agents, and employees from any claim or demand made by any third party due to or arising out of your breach of these SMS Text Messaging Terms and Conditions, or your violation of any law or the rights of a third party.

7.  Changes to Terms

Graco may revise, modify, or amend these SMS Text Messaging Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to Graco’s website. You agree to review these SMS Text Messaging Terms and Conditions periodically to ensure that you are aware of any changes.
